Mystery solved! Guus confirmed:
I'm afraid that i have send a batch to Gigaparts with a limited QRG from 430 - 440.
Normally the radio should be useable up to 450.
With new firmware you can use the DVMEGA outside 430 - 440.
Did you ever update the firmware ?
For what it's worth... the DVMega that I just received last week had the same issue. Would not work on 445.95... I thought I was being clever, picking a simplex frequency. Then I looked over a friend's code plug and saw he used 434.xx. I switched to that frequency, and voila!

Time to update my firmware!

At least that is some good news, that the expanded range is only a firmware update away :)

That's all it takes -- I flashed the latest DVMega firmware onto the Atmel chip that was on a "spare" Arduino Uno, put that chip onto my DVMega, and now it's happy to be on the upper frequency range.
